Data Processing Consent Agreement

Nataliia Gach Education Centre “L&D initiatives” (the Centre) collects the data you voluntarily provide (e.g., full name, email address, phone number) when you submit your message on our website. We send these details via email to our designated mailbox so that our staff can respond to your inquiry. We use this data only to communicate with you and handle your request. We do not use it for marketing, profiling or any other purposes. In accordance with Switzerland’s Federal Act on Data Protection (FADP) and the EU’s General Data Protection Regulation (GDPR), we provide the following clear information about this processing.

Collected Data

We collect the following information when you submit the contact form:

• Full Name – so we can address you and identify your request.
• Email Address – so we can send you a reply.
• Phone Number – so we can contact you by phone if needed for clarification.

These data are received by the Centre via email. The email system is secured and accessed only by authorized staff. We do not share your personal data with any outside parties except (if necessary) to our email service provider or as required by law. Your data stays within Switzerland/the EU and any transfer out of Switzerland/EEA is subject to legal safeguards.

Legal Basis for Processing

By ticking the consent checkbox, you explicitly give your consent to the Centre to process the provided personal data. Under the GDPR, processing is lawful only if one of its legal bases applies – in our case, Article 6(1)(a) permits processing with the user’s freely given consent. Consent must be an unambiguous, affirmative act; our checkbox ensures a clear opt-in, as required by law. The revised Swiss FADP aligns with these standards: it requires that consent be freely given, specific and informed to be valid. In practice, this means we have told you exactly what data we collect and why, and you have agreed by checking the box.

Purpose of Processing

The sole purpose of processing your contact data is to handle your request or inquiry. In other words, we use your name, email, and phone number to communicate with you and provide the information or service you asked for. This purpose is clearly explained before you consent. We will not use your data for any purpose other than responding to your inquiry.

Data Retention

We retain your personal data only as long as necessary to fulfill the purpose of your inquiry and for any legally required retention period. After we have closed your inquiry (and any follow-up period), we will securely delete or anonymize your data.

Your Rights under FADP and GDPR

You have full control over your personal data. Under both Swiss law and the EU GDPR, you have the following rights:

• Access and information: You can request confirmation of what data we hold about you and receive a copy of it.
• Correction: If your data are inaccurate or incomplete, you can ask us to correct them.
• Deletion: You can request deletion of your personal data when it is no longer needed for the purposes collected, or if you withdraw consent. (Note: We may be required to keep some data for legal reasons.)
• Restriction of processing: You can ask us to pause processing (e.g., during dispute of accuracy) under certain conditions.
• Data portability: You may request a machine-readable copy of your data for use elsewhere, where technically feasible.
• Objection: You can object to our processing of your data on grounds of public interest or legitimate interest, unless we have an overriding justification.
• Withdrawal of consent: You can withdraw your consent for any processing (e.g., marketing emails) at any time without affecting the lawfulness of prior processing.
• Complaint: You have the right to lodge a complaint with a supervisory authority. In Switzerland, this is the Federal Data Protection and Information Commissioner (FDPIC). EU residents may also contact their local data protection authority.
